    The Fair Use Law Podcast Thread

    Just wanted to drop everyone on the forum a line and get some feedback on a podcast my friends and I have been doing for 4 months now. It's called Fair Use Law and you can check it out over at http://fairuseradio.com

    We're three 20-somethings stuck in Central (or, if you are the marketing team behind A Haunting in Connecticut, Southern) Connecticut, lashing out about working in insurance with a podcast that just happens to be as ADHD as we are. Topics fly fast and furiously, but we do stick to our nerd cachet of talking about video games, comic books, movies, and the Cloverfield monster. New episodes go up every Sunday and run just about an hour and change weekly.

    As and ye shall receive:

    Fair use is a doctrine in United States copyright law that allows limited use of copyrighted material without requiring permission from the rights holders, such as use for scholarship or review. It provides for the legal, non-licensed citation or incorporation of copyrighted material in another author's work under a four-factor balancing test.


    1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
    2. the nature of the copyrighted work;
    3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole;
    4. the effect of the use upon the potential market for or value of the copyrighted work.

    Producers or creators of parodies of a copyrighted work have been sued for infringement by the targets of their ridicule, even though such use may be protected as fair use. These fair use cases distinguish between parodies (using a work in order to poke fun at or comment on the work itself) and satires (using a work to poke fun at or comment on something else). Courts have been more willing to grant fair use protections to parodies than to satires, but the ultimate outcome in either circumstance will turn on the application of the four fair use factors.
    Of special note to the interest of AST, Fair Use Law could be considered "that Weird Al Law" Belknap mentioned on Never Not Funny. Weird Al does not have to ask permission from the original artist to do a parody, but he does personally after Coolio's reaction to Amish Paradise.

    Resurrecting this thread because the show is starting up again...and I will be the new third chair/internet research lackey. I'll be joining Dan and Randy who already have great chemistry on the mics to join in on bits and tell them when they're wrong. We're recording a pilot re-launch episode on Tuesday, would love to get as much feedback on it from people here as possible.

    I'll post again on Tuesday before we record because we do have a voicemail call-in line for people to call us and ask anything so that we can berate you. We know you have a wide variety of choices when it comes to listening to podcasts and we thank you for your patronage.

    Season 5 is now in full effect with 501 and 502 already recorded and posted. I'd love to hear any and all opinions of the show you might have.
